Blue Nile Sued by Hearts on Fire for Trademark Infringement
June 25, 08Hearts on Fire Inc. has filed a lawsuit against Blue Nile Inc., alleging trademark infringement and unfair competition. Hearts on Fire says Blue Nile bought the search phrase “hearts on fire,” which is directing traffic to bluenile.com, Bloomberg reports.
According to the complaint filed in federal court in Boston, the use of the keywords misdirects those who are searching for Hearts on Fire Diamonds and violates Hearts on Fire's trademark.
This, Hearts on Fire says, “misappropriates the goodwill” the firm built over the years. Blue Nile isn't an authorized seller of Hearts on Fire diamonds.
Hearts on Fire asked the court to order Blue Nile to quit infringing the trademark and for damages, including profits gained from the infringement.
